Upon granting New Auto FZCO rights to use the Content, New Auto FZCO has the unlimited, perpetual, irrevocable, royalty-free, sub-licensable, worldwide right to use, copy, reproduce, distribute, perform, display, modify, or create derivative works of the Content for any lawful purpose in its sole discretion;

By granting the license in the preceding sentence, you warrant that the owner of any rights in such Content has fully and effectively waived all such rights and has validly and irrevocably granted you the right to grant the license;

In this agreement, you grant New Auto FZCO the right to prohibit the subsequent access, storage, reproduction, or use of the Content by any party to the extent determined by New Auto FZCO.

Neither New Auto FZCO nor its agents are responsible for any information posted, transmitted through, or linked to the Website, and no reliance should be placed on that information.

Any Content posted on the Website may be refused to share or display, moved, or deleted by New Auto FZCO at its discretion.

New Auto FZCO is committed to updating the Website regularly and may change the Content at any time. Any of the Content may be out of date at any given time, and we are under no obligation to update it.

New Auto FZCO is not responsible for any User Content that offends another’s rights.

New Auto FZCO may screen and monitor any Content but does not have to do so. If New Auto FZCO receives notice that Content infringes third-party rights, it may investigate the allegation and decide in its sole discretion whether to remove the Content or request its removal. It is not the responsibility of New Auto FZCO to perform or not perform such activities for users.

6. PRIVACY POLICY

We at New Auto FZCO respect your privacy and have developed a detailed Privacy Policy that is incorporated into this Agreement. We encourage you to take the time to read our Privacy Policy located here: Privacy Policy. Acceptance of these Terms also implies acceptance of our Privacy Policy.

7. ACCESSING THE WEBSITE AND LINKING TO IT

New Auto FZCO grants you access to the Website on a non-exclusive, temporary, and revocable basis, and New Auto FZCO reserves the right to withdraw or amend that right at any time.

The Website will not be available at any time or for any period for any reason at the discretion of New Auto FZCO.

You may not:

To access New Auto FZCO through a robot spider, scraper, or other automated means to collect content or to copy or download content. There is a limited exception for search engines and non-commercial public archives, but not for websites that have classified listings; and

9. ACCEPTABLE & CONDUCT USE; NO SPAM

The Content you upload, email, or make available through the Website must not be objectionable to New Auto FZCO or in violation of applicable laws or regulations. By using the Website, you agree not to post, email, or otherwise make available any content that:

  • Affecting minors in any way, whether unlawful, harmful, threatening, abusive, defamatory, libelous, invasive, or otherwise discriminatory;
  • Criticizes any government or municipal employee in any jurisdiction, whether or not it is political;

  • Affirms anti-Islamic, derogatory views about Islam;

  • Contains a falsehood or deception;

As a further agreement, you agree to refrain from:

  • Make contact with people who do not wish to be contacted;
  • Intimidate or harass other website users;
  • Obtain personal information about users for commercial or unlawful purposes;
  • Post content that is irrelevant or unrelated to the category or discussion thread in which it appears;
  • Post the same product or service in more than one category;
  • Any spam, junk mail, chain letters, pyramid schemes, or unsolicited email advertisements to New Auto FZCO or others using the Website; or posting, emailing, making available, or contacting other users of the Website with spam, junk mail, chain letters, pyramid schemes, or unsolicited email advertisements.

The above list of prohibited content and actions is not exhaustive and New Auto FZCO reserves the right to (i) remove content that it considers (in its absolute and sole discretion) to be objectionable or in violation of applicable laws or regulations without notice, and (ii) take the necessary steps to prevent individuals from accessing the Website who post content and/or conduct themselves in a manner that violates this Clause 9.

10. DEALINGS WITH INDIVIDUALS AND THIRD-PARTY ORGANIZATIONS

New Auto FZCO operates the Website as an online marketplace for buying, selling, and exchanging cars. Neither New Auto FZCO nor its affiliates sell any of the items listed on the Website directly, nor do we take part in any transactions between buyers and sellers. Due to this, New Auto FZCO does not (a) guarantee or guarantee any item listed on the Website or any transaction between buyers and sellers, (b) collect or process payment or title transfers on behalf of buyers or sellers, or (c) warehouse, store, ship, or deliver any item listed on the Website. Additionally, New Auto FZCO will not be liable for any interactions or dealings between you and other users of the Website. New Auto FZCO is neither responsible for nor holds itself out as promoting these interactions or dealings.

New Auto FZCO is not responsible for the Content, actions, or inactions of other users, items they list, or for the destruction of allegedly fake items. Even though we may assist in resolving disputes, New Auto FZCO is not obligated to get involved in disputes between your and other users. There is no guarantee that an item advertised will be of high quality, safe, or legal quality, nor do we guarantee the truth or accuracy of users’ Content or listings, that seller will be able to sell items, buyers will be able to pay for items, or that a seller or buyer will complete or return a transaction. There are some categories of transactions for which an offer initiates a transaction representing a serious buyer’s interest in buying the seller’s item and makes no formal contract between buyer and seller.

Unless otherwise indicated, New Auto FZCO is not responsible for monitoring, verifying, or approving Content, and you are solely responsible for inspecting the Website for accurate Content.

In respect of the website or any services provided hereunder, new auto fzco disclaims any representations or warranties, whether oral or written, express or implied, or arising by statute, custom, course of dealing, or trade usage. Implied warranties or conditions of title, merchantability, fitness for a particular purpose, or non-infringement concerning any services or goods you buy.

Assuring the website’s accuracy, timeliness, security, and performance; or

Errors, viruses, trojans, worms, logic bombs, or any other malicious teachings that may harmfully affect your system.

12. LIABILITY LIMITATIONS

As far as applicable law permits, New Auto FZCO hereby disclaims all liability for any kind of damages whatsoever (including, without limitation, direct, indirect, special, punitive, incidental, or consequential loss or damage incurred by users in connection with the Website, any websites linked to it, or any materials posted on it, in connection with the use, inability to use, or results of the use of the Website. In particular, this includes liability for loss of income or revenue; loss of business; loss of profits; loss of contracts; loss of anticipated savings; loss of data; loss of goodwill; waste of management or office time; and any other damage, whether caused by tort (including negligence), breach of contract or otherwise.

Viruses, distributed denial-of-service attacks, or other technologically harmful materials may damage your computer equipment, computer programs, data, or other proprietary material if you use the Website or download any material from it, or any website linked to it.

13. INDEMNITY

A claim, action, demand, damages, losses, or attorney fees resulting or arising from the use or misuse of the Website or Content, or your violation of any third party’s proprietary rights, may result in you indemnifying, defending, and holding New Auto FZCO and its shareholders, officers, directors, employees, and agents from any claims, actions, demands, damages, losses, or attorneys’ fees arising from your use or misuse of the Website or any Content. Any dispute between you and any of the Website users is subject to this agreement

14. Cancellation of Access to the Website

For any violation of these Conditions of Use at any time without prior notice, New Auto has the right to restrict you from using the Website or to immediately terminate your access.

New Auto is free to remove any of your content from the website at any moment. Any termination of your access to the website or removal of your posted content by New Auto is not subject to liability to you or any third party. After termination, you agree not to try to access the website.

New Auto reserves the right to take whatever actions it deems reasonably necessary or appropriate to enforce and/or verify compliance with any of these Terms of Use ( including New Auto’s right to cooperate with any legal process related to your use of the website and/or third-party claim that your use of the website is illegal and/or violates such third party’s rights).

You acknowledge and agree that New Auto is free to disclose any registration information and/or account information to law enforcement officials, government officials, and/or third parties).

17. Payment and Cancellation

Services- Customers can purchase and access a variety of premium services from various pages on newautofzco.com. Payment – The whole amount must be received in advance prior to the start of the Service. Mastercard and Visa credit cards are accepted. Any current or upcoming sales, use, excise, or other comparable taxes (aside from taxes based on newautofzco.com’s net income) applicable to the services under this agreement will be your responsibility to pay. The amount paid hereto is not refundable.

Refunds and Cancellations: All refund requests will be examined individually and granted newautofzco.com’s sole discretion. Any authorized refunds will only be issued in the original payment method.

Credit Card Information: The information gathered does not include consumer credit information. None of your credit card data will be kept, sold, shared, rented, or leased to any outside parties.

18. General

You acknowledge that the electronic format of these Terms of Use has no bearing on their legality or enforceability. The agreement between you and New Auto regarding its subject matter is entirely included in these Terms of Use, which supersede any contemporaneous or earlier oral or written agreements, representations, understandings, or discussions between you and New Auto whether implied or stated.

New Auto does not relinquish its right to take action in the future in the event that we delay or fail to act upon a breach of these Terms of Use. The provisions of these Terms of Use shall be deemed severable, and if any provision is found to be contrary to applicable law or unenforceable, it may be amended to the extent deemed reasonable to render the provision, as changed, enforceable and legal.

Without the express written consent of New Auto, you are not permitted to assign any portion of these Terms of Use. When a notice of the assignment is posted on the website, New Auto may assign these Terms of Use immediately.

Privacy Policy

Any dispute regarding the existence, legality, or termination of these Terms of Use, or in connection therewith, shall be finally resolved by binding arbitration.

The arbitrator’s decision is final and enforceable against both parties. The winning party may be given reasonable legal costs and arbitration fees by the arbitral tribunal.

Any court with jurisdiction over the matter or the relevant party or its assets may enter the judgment passed on the award provided by the arbitrator(s).

Any party may request temporary relief from any court with jurisdiction over it, the relevant party, or its assets if the arbitral panel has not yet been formed. You and New Auto hereby submit such jurisdiction for a limited purpose.

20. Modifications of use

New Auto retains the right to alter these Terms of Use at any time and on a regular basis (collectively, “Additional Terms”), as well as to impose new and/or additional rules, policies, terms, and/or conditions on your use of the Website. These Additional Terms will become a part of these Terms of Use and take effect right away. You have accepted all of these Additional Terms if you continue to use the Website. Any Additional Terms are hereby referenced in and made a part of these Terms of Use.
